Terms of service

These Terms of Service ("Terms") apply when you use our website at avantifurniture.net (the "Site") or buy products or services from Lems Style Corp., doing business as Avanti Furniture ("Avanti Furniture," "we," "us," or "our"), whether in our Weston showroom, by phone or email, or through online checkout. Please read them carefully.

Key points

  • Most products on the Site are "Price on request." You receive a written quote, and your quote / sales order sets out the specific terms of your purchase.
  • If your quote / sales order says something different from these Terms, your quote / sales order applies to that purchase.
  • Many items are special-order or custom and are made to order by the manufacturer. Once we have placed the order with the manufacturer, they are final sale and cannot be cancelled or returned, except as described in our Return and Refund Policy or on your sales order.
  • Colors and finishes on screens may differ from the actual materials, natural materials vary, and dimensions are approximate.
  • Products come with the manufacturer's warranty where the manufacturer provides one, and we help you with warranty claims.
  • These Terms are governed by Florida law.

Who we are

Avanti Furniture is the business name of Lems Style Corp. Since 2001, we have sold modern and contemporary furniture, mostly Italian, for living, dining, bedroom, office and outdoor spaces. Our showroom is at 111 Weston Road (Shoppes on the Green), Weston, Florida. We also offer interior design services, a Trade Program for designers, and financing through third-party lenders. Our online store runs on Shopify.

Accepting these Terms

  • By using the Site, requesting a quote, or placing an order, you agree to these Terms.
  • If you do not agree, please do not use the Site or place an order.
  • These Terms work together with your written quote / sales order and with our other policies:
  • If your quote / sales order states terms that are different from these Terms, the terms on your quote / sales order apply to that purchase.

Using our website

You may use the Site to browse our products, learn about our services, contact us, request quotes, and shop. When you use the Site, please:

  • use it only for lawful purposes and as these Terms allow;
  • give accurate information in forms, quote requests, chats and orders;
  • send us only files, photos or other content that you have the right to share; and
  • if you create an account, keep access to your account secure and tell us if you think someone else has used it.

Please do not:

  • try to gain unauthorized access to the Site, our systems, or other people's information;
  • interfere with how the Site works, or upload viruses or other harmful code;
  • copy Site content in bulk with bots, scrapers or other automated tools, or try to get around the Site's security features (this does not apply to the sales channels and AI shopping assistants our store supports through Shopify, which are described in our Privacy Policy);
  • send spam, false or misleading information, or unlawful content through our forms or chat; or
  • pretend to be someone else.

We may limit or block access to the Site for anyone who misuses it.

Product information

We work to describe and show our products accurately. Please keep the following in mind:

  • Images and colors. Product images, colors and finishes on screens may look different from the actual materials.
  • Natural materials. Wood, leather, marble, ceramic and fabric vary from piece to piece. These natural variations, and on-screen color differences, are not defects.
  • Dimensions. Dimensions on the Site are given in inches and are approximate.
  • Availability and specifications. Manufacturers may change or discontinue products, finishes, materials and specifications, so a product shown on the Site may not always be available exactly as shown.
  • Confirm before you order. Please confirm the details that matter to you, such as finish, fabric, leather, size, configuration and dimensions, with us, and check them on your quote / sales order.

We may correct errors in product information and update the Site at any time.

Prices and quotes

  • "Price on request." Most products on the Site do not show a price. To buy one, contact us by phone, email, our contact form or chat, or visit our showroom, and we will prepare a written quote for you.
  • Your quote. Your quote lists the items and options you chose, their prices, the delivery fee, and any other charges for your purchase. Sales tax is added where the law requires it.
  • Quote expiration. If your quote shows an expiration date, its prices apply until that date. After it, prices and availability may change, and we may need to give you a new quote.
  • Price changes. Prices shown on the Site may change at any time. A change to prices on the Site does not change the price on a sales order you have already signed or approved, except to correct a pricing error as described below or as your sales order states.
  • Pricing errors. A price on the Site, on a quote or at checkout may occasionally be wrong because of a typing or system error. We may correct pricing errors. If an error affects an order you have already placed, we will contact you before going ahead. You can then choose to continue at the correct price or cancel that item and receive a refund of what you paid for it.

Orders and payment

Your written quote / sales order

Every purchase is documented on a written quote / sales order. It sets out the specific terms of your purchase, including:

  • the items, finishes, fabrics or leathers, sizes and configurations you chose;
  • your deposit amount and payment schedule;
  • the delivery fee and estimated delivery date;
  • any cancellation or restocking fee; and
  • warranty details.

Please review your quote / sales order carefully before you sign or approve it, and ask us about anything that is unclear.

Deposits and payment schedule

  • Your deposit amount and payment schedule, including any amount due before delivery, are stated on your quote / sales order.
  • Please make your payments as stated there. We may hold delivery until any amount due before delivery has been paid.

Special-order and custom items

Many of our products are special-order or custom. You choose the finish, fabric, leather, size or configuration, and the manufacturer, often in Italy, makes the piece to order for you. Because of this:

  • lead times vary by item, and your estimated delivery date is on your quote / sales order;
  • delivery dates are estimates, not guaranteed dates, and if your estimated date changes, we will let you know; and
  • once we have placed your order with the manufacturer, a special-order or custom item is final sale and cannot be cancelled or returned, except as described in our Return and Refund Policy or on your sales order.

When we may cancel an order

We may decline or cancel an order, or part of an order, for example if a product is discontinued or cannot be supplied by the manufacturer, if there is a pricing or product information error, or if we suspect fraud. If this happens, we will contact you. Where it makes sense, we will discuss other options with you. If we cancel an item, we will refund what you paid for it.

Services

Services such as delivery, assembly, installation, space planning and interior design are provided as described on your quote / sales order or in any separate written agreement we make with you for that service. See our Services page for more about what we offer.

Online checkout

  • A small number of products show a price on the Site and can be bought through online checkout.
  • Checkout is provided by Shopify. Shopify and its payment processors handle your payment details. We do not receive or store your full card number.
  • Shipping or delivery charges and applicable taxes are shown at checkout or on your quote.
  • An order confirmation means we have received your order. If there is a problem with your order, such as availability or a pricing error, we will contact you.
  • After you place an online order, we will contact you to arrange delivery.
  • These Terms, our Shipping and Delivery Policy and our Return and Refund Policy apply to online orders in the same way as to other purchases.

Delivery

We deliver throughout South Florida (Broward, Miami-Dade and Palm Beach counties) using professional third-party delivery and installation companies, and we can quote delivery to other areas on request.

Delivery fees, estimated delivery dates, scheduling, how to prepare for delivery, and inspecting your furniture are covered in our Shipping and Delivery Policy and on your quote / sales order.

Returns, cancellations and refunds

Returns, cancellations and refunds are covered by our Return and Refund Policy and your quote / sales order. Please read the policy before you order. In particular:

  • Special-order and custom items are final sale. They cannot be cancelled or returned once we have placed the order with the manufacturer.
  • In-stock and floor-model items are final sale unless your sales order says otherwise.
  • Final sale means no refunds, exchanges or store credit. The only exceptions are items that arrive damaged or defective or that are not what you ordered, anything your sales order specifically allows, and any case where the law requires otherwise.
  • We do not accept returns without our prior authorization. Please contact us first.
  • Damage or defects: inspect your furniture at delivery and contact us as soon as possible if there is a problem. The policy explains how to report it.

Warranties

  • Manufacturer warranties. Our products come with the manufacturer's warranty where the manufacturer provides one. Warranty details are on your quote / sales order, and the manufacturer's warranty terms apply.
  • Help with claims. If you have a warranty concern, contact us and we will help you with the claim.
  • No other warranties. To the extent permitted by law, and apart from any manufacturer warranty and anything stated in writing on your quote / sales order, we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some states do not allow these exclusions, so they may not apply to you. This does not affect any manufacturer warranty or any rights you have under applicable law.
  • The Site. To the extent permitted by law, the Site and its content are provided "as is" and "as available." We do not promise that the Site will always be available, uninterrupted or free of errors.

Financing

  • Financing is provided by third-party lenders, not by Avanti Furniture. See our Financing page.
  • Financing is subject to the lender's credit approval. Approval is not guaranteed, and we do not control the lender's decisions.
  • You apply with the lender, and your financing agreement is between you and the lender. The lender's own terms, including any rates, fees, payment terms and promotional offers, apply. Please read them before you apply.
  • If a refund is approved for a purchase you financed, it is processed through the lender and applied to your financing account under your agreement with the lender, as described in our Return and Refund Policy.

Limitation of liability

To the extent permitted by law:

  • Avanti Furniture is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, arising from your use of the Site or from any product or service we sell.
  • Our total liability for any claim relating to a product or service is limited to the amount you paid us for that product or service.
  • We are not responsible for delays caused by events outside our reasonable control, such as manufacturer production schedules, international freight delays, or severe weather.

Nothing in these Terms limits our liability for fraud, intentional misconduct, or anything else that cannot be limited under applicable law. Nothing in these Terms limits any rights you have under applicable law, including any legal right to cancel a purchase or a delayed order, or any rights you have under a manufacturer's warranty.

Intellectual property

  • The Site and its content, including text, product photos, images, graphics, logos and design, belong to Avanti Furniture or to others who allow us to use them, such as the manufacturers whose products we sell. They are protected by copyright, trademark and other laws.
  • The Avanti Furniture name and logo belong to us. Manufacturer brand and product names belong to their owners.
  • You may view and print pages of the Site for your personal use, such as planning a purchase. You may not copy, reproduce, publish, sell or otherwise use Site content for commercial purposes without our written permission.

Communications and marketing

  • When you contact us, request a quote or place an order, we may call, text or email you about your inquiry, quote or order.
  • Marketing emails, calls and text messages, including how to opt in and how to opt out, are covered by our Privacy Policy. Consent to receive marketing calls and texts is not a condition of purchase.
  • Our Privacy Policy also explains how we collect, use and share your information, including through cookies, live chat and our forms.

Third-party websites and services

The Site uses and links to websites and services that we do not control, such as Shopify's checkout and its payment processors, our financing lenders' websites, sales channels and AI shopping assistants you choose to use (such as the Shop app or Google), and other websites we link to. Their own terms and privacy policies apply when you use them. We are not responsible for their content, availability or practices.

Governing law and disputes

  • These Terms, your use of the Site, and your purchases from us are governed by the laws of the State of Florida, without regard to its conflict-of-law rules.
  • Any legal action relating to these Terms, the Site or a purchase must be brought in the state or federal courts located in Broward County, Florida, and you and we agree to the jurisdiction of those courts, except where applicable law gives you the right to bring a claim elsewhere.
  • If you have a concern, please contact us first. We will do our best to resolve it with you.

Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a new "Last updated" date, and the changes apply from that date. The Terms in effect when you place an order apply to that order, together with your quote / sales order.

General

  • If any part of these Terms is found to be unenforceable, the rest of these Terms stays in effect.
  • If we do not enforce part of these Terms right away, we can still enforce it later.
